***Terms and Conditions of Use***
Welcome to the Proust Sailing website. Proust Sailing is a web-based service owned and provided by SELARL KEREVEUR ET GRENET. SELARL KEREVEUR ET GRENET’s registered office in France is located at F-29790 Pont Croix, 28 boulevard du Général de Gaulle, 443 697 842 R.C.S. QUIMPER. By using the Site, the Client agrees to be bound by the Terms and Conditions set out below. These General Terms and Conditions of Sale and Use govern the access and use of Proust Sailing website (the “Website”), for the Client's personal use only, and the offer, transmission, acceptance of purchase orders and sale of products (the “Product(s)”) to the Clients (the “Client” or “you”, “your” “he/she”, “her/his”).
Please read these Terms of Use carefully before using Proust Sailing. If you do not accept the terms and conditions as described below, you should immediately stop using this service.
Proust Sailing reserves the right, in its sole discretion, to modify, alter or otherwise update these Terms of Use at any time and, by your continued use of the site, you agree to be bound by such modifications, alterations or updates.
***Article 1 – Pricing*** Proust Sailing‘s acceptance of an order takes place on despatch of the order, at which point the purchase contract will be made and the Client will be charged for his/her order. All prices shown on the Website are in euro and are inclusive of VAT at the appropriate rate. The price does not include the delivery and packaging costs, which will be given to the Client with the confirmation of his/her order.
Any order delivered out of the European Community might be subject to local taxes and customs duties. These taxes and duties are at the customer’s expense and responsibility.
All orders must be paid in EURO currency, using VISA or Mastercard.
Prices may change and offers from Proust Sailing may be withdrawn at any time. However, the Client will pay the price indicated when his order is made and registered by Proust Sailing, upon the condition of the availability of the Product.
Ownership of the goods shall not pass to the Client until Proust Sailing has received payment in full.
***Article 2 – Order*** In order to place an order for the purchase of one or more Products on the Website Proust Sailing, the Client must fill out the online order form. Proust Sailing
By submitting an order form, the Client is contracting with Proust Sailing and agrees unconditionally, accepts and undertakes to observe the provisions of these Terms and Conditions of Sale and Use.
The customer agrees to pay the selling price current at the time of his seizure of the order.
Once the payment is validated and the order is considered as registered with Proust Sailing, a summary of the purchase order will be sent by email to the Client's registered email address provided before. The summary will list all the details of the contract, order and the Product purchased.
Proust Sailing is entitled to refuse an order from a previous Client with whom a claim is pending for non-payment, late payment, or insufficient guarantees of solvency or arisen disputes about goods, delivery, return, refund, payment or other breach of the Terms and Conditions. Proust Sailing will not be responsible for refusing to process the Client's order. Proust Sailing may suspend or cancel the Client’s registration immediately at its reasonable discretion or if the Client breaches any of the obligations under these Terms and Conditions. Proust Sailing reserves the right to cancel or refuse an order placed by a customer leaving outside the European Union, without justifying the reasons for making the decision.
***Article 3 – Validation*** All orders placed for an item on the site assume consultation and acceptance beforehand of these Terms and Conditions of Use as well as full legal capacity for commitment..
Once the payment is validated, the order is registered and cannot be amended or cancelled thereafter. The order is registered on the Proust Sailing electronic registrars, which are stored on durable means and are recognised as admissible evidence in legal proceedings.
***Article 4 – Product Availability*** Proust Sailing lists availability information for products sold on the Website, including on each product information page. Beyond what is said on the Website, Proust Sailing cannot be more specific about availability. Please note that dispatch estimates are not guaranteed dispatch times and should not be relied upon as such.
As Proust Sailing processes the order, the Client will be informed by e-mail, within thirty (30) days if any products ordered turn out to be unavailable. The order would be deemed to be cancelled and the Client will receive a refund.
Pictures and other visual images are just indications of what Products could be and they are not binding Proust Sailing.
***Article 5 – Delivery*** All orders are dispatched with a receipt to the Client's address, as indicated during the ordering process. All the delivery times are estimates, not guaranteed dispatch times, and should not be relied upon as such. National or Local restrictions and the effect of adverse weather conditions may affect deliveries. Every effort will be made to complete deliveries but Proust Sailing cannot be responsible for restrictions out of its control or any delays caused by postal service.
If articles must be delivered at different dates according to their availability, the delivery will be based on the expensive one. Proust Sailing reserves the right to split the delivery. In this case the customer will be invoiced for only one delivery. Proust Sailing will always contact the Client if Proust Sailing is made aware of any problems..
***Article 6 – Payment*** Payment online can be made exclusively with credit cards :

- Eurocard & MasterCard
***Article 7 – Security*** The Website Proust Sailing is secured making use of the SSL encryption (Secure Socket Layer), to protect at its best effort all confidential details provided for the payment. The Client’s payment details are transferred directly to the bank, which also operates under the secure SSL encryption. At no time, the Client's payment details are transferred through Proust Sailing electronic system. Proust Sailing will not be responsible for any consequences related to the payment stage.
***Article 8 – Product Conformity*** If, the product delivered :
- is not in conformity with the order,
- is defective,
- is damaged...
Under the distance selling regulations, the Client has the right to withdraw from the purchase of an item within seven (7) working days beginning with the following day on which the Client receives the goods.
The Client must apply in writing and return the Product in good condition, with all original packaging, accessories and documentation at the following address:

Any damaged item, or damaged original packing, will not be refunded, nor exchanged.
If customers try to return anything abusively, Proust Sailing may suspend or cancel the Client’s registration immediately at its reasonable discretion .
***Article 9 – Reimbursement*** Refunds of products referred to in article 8 will be made within fifteen (15) days after receiving the products.
The customer will be reimbursed either by bank cheque made in the name of who has placed the order and sent to the invoicing address, or by credit to his bank account, according to the payment mode of the order.
***Article 10 – Right of Retraction *** Under the distance selling regulations, the Client has the right to withdraw from the purchase of an item within seven (7) working days beginning with the following day on which the Client receives the goods. Shipping and return costs are at the customer’s expense. This right of retraction is without penalty, except for return postage. Only price of products bought will be reimbursed.
In conformity with the law, the customer has seven (7) working days to return at his own expense, the unwanted items. Products will have to be sent in their whole, in original and complete packing, and intact, and in perfect state of resale. Any damaged item, or damaged original packing, will not be refunded, nor exchanged. All returns should be sent at the following address :

***Article 12 – Intellectual Property and Third Party Websites*** The content of the Site, created for Proust Sailing, is protected by copyright, trademarks, database and other intellectual property rights.
The Client may retrieve and display the content of the website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided the Client keep intact all and any copyright and proprietary notices. The Client may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Website without written permission from Proust Sailing.
No licence is granted to the Client in these Terms and Conditions to use any trademark of Proust Sailing or its affiliated companies.

***Article 13 – Responsibility*** All products for sale on the site are in conformity with the French legislation in force. Proust Sailing cannot be held responsible for not respecting the legislation of another country where the product would be delivered.
